The opposition period against a published mark in South Korea will be reduced by half, from two months to 30 days, effective July 22, 2025. This change makes monitoring of potentially infringing trademarks in Korea even more crucial. Importantly, this shorter period applies to trademarks published on or after July 22, 2025, not merely those filed from that date.
This reduction in the opposition period is anticipated to help decrease the overall duration of examination for trademark applications. While it took approximately six months to receive the first office action in Korea as of 2019, the pendency has been extended to 13 months by the end of 2024 due to an increasing number of trademark filings, causing concerns about examination backlogs. As of the end of May 2025, the average time has been reduced to 12 months.
Should the opposition period lapse, a legitimate rights holder still retains the option to submit an information brief to argue against registration of the published trademark. However, given that a decision to grant registration may be issued within one month after the opposition period closes, timely action is crucial. Once the trademark is registered, any subsequent challenge would necessitate a trial for invalidation at the Korea Intellectual Property Tribunal.
From the applicant’s perspective, opting for expedited examination offers the benefit of reducing the examination period from over one year to roughly two months. This request, however, requires a statement of the planned use of the mark and the payment of an additional official fee of approximately $120 USD.
